USCIS Resumes Premium Processing for all FY 2020 Cap Subject H1B Petitions
On June 10, 2019, the United States Citizenship and Immigration Services (USCIS) began premium processing all remaining H1B petitions subject to the FY 2020 H1B cap [PDF version]. Petitioners may file the Form I-907, Request for Premium Processing Service, with the USCIS service center that is processing the applicable H1B petition.
From June 10, 2019, through June 24, 2019, the USCIS will not use pre-paid mailers to send out final notices for premium processing of FY 2020 cap-subject H1B petitions not requesting a change of status. The USCIS will instead use regular mail during this period “due to resource limitations…” The USCIS will resume using pre-paid mailers provided by petitioners after the two week period “when operationally feasible.”
This represents the second phase of the USCIS's premium processing of FY 2020 cap-subject H1B petitions. During the first phase, which started on May 20, 2019, the USCIS began premium processing of FY 2020 cap-subject H1B petitions requesting a change of status. This second phase extends premium processing to all FY 2020 cap-subject H1B petitions.
Premium processing of H1B petitions that are exempt from the H1B cap remains available.
We discuss many issues involving the FY 2020 H1B cap filing season in a separate post [see article]. We also discuss premium processing of Form I-129 petitions generally in a different article [see article].
