Outcome: Asylum was granted

In this case, the husband and wife were detained after seeking asylum at the border and spent over a year in different detention facilities. Each had their asylum applications heard by separate judges. In the Husband’s case, the judge approved asylum, and he was released from ICE detention. In my wife’s case, IJ denied asylum, and we appealed. BIA remanded the case to the IJ to determine whether Wife was eligible for derivative asylum, since her husband had been granted asylum and she was included in his application. The IJ determined that she did and granted her derivative asylum.
